Crime Numbers

The New Jersey Department of Law and Public Safety provides crime data for all the counties in the state. Its most recent figures for Burlington County are for 2017. In that year, the county recorded 13 murders, 109 rapes, 179 robberies, and 369 aggravated assaults. Larceny-theft was the leading property crime with 4,799 incidents followed by 1,183 burglaries and 334 motor vehicle thefts.

Compared to the 2013 crime data for the county, murder (44.4%), rape (28.2%), aggravated assault (9.2%), and motor vehicle theft (7.1%) rates increased in 2017. On the other hand, the five-year crime trend for Burlington County indicates falling robbery (37%), burglary (34.5%), and larceny-theft (14.5%) rates.

Criminal Records

The New Jersey State Police (NJSP) provides criminal history checks for all the counties in the state. It offers fingerprint-based background checks via IDEMIA, a third-party vendor that delivers regular and notarized criminal history reports. This line is available between 8:00 a.m. and 5:00 p.m. from Monday through Friday and 8:00 a.m. and 12 noon on Saturday. You can also make an appointment online via www.bioapplicant.com/nj. Bring the completed fingerprint form to your appointment. The NJSP charges $40.66 for this service plus $10 for vendor fee and state tax.

The various boroughs, cities, and towns of Burlington County have their own local police departments. These law enforcement agencies provide incident and accident reports for events that happened within their jurisdictions. Burlington County has one Superior Court, one Surrogate's Court, and 39 Municipal Courts. The Superior Court is the primary trial court and oversees the Municipal Courts. The New Jersey Courts provides online access to the records of Burlington County Superior and Municipal Courts on its website. This is a subscription-based access that requires users to register with the site and pay to search records and view court documents. You can request for copies of Burlington County court records by email. New Jersey Courts charges 5 cents per page for letter size documents of plain copies of court records. The fee for legal size pages is 7 cents per page. The cost of a certified copy is $15 while an exemplified record costs $50 plus copy fees and a triple exemplified copy costs $60. You can pay these fees in cash when requesting for court records at courthouses. Checks and money orders are accepted for email requests. Make these payable to Treasurer-State of New Jersey.

Vital Records

The Family Division of the Superior Court maintains the divorce records for Burlington County and sends them to the Superior Court Clerk's Office in Trenton. Request for your divorce record should go to the Superior Court Clerk's Office. Send an email request by submitting a Records Request Form to [email protected] The fee for each copy of divorce record is $35. Pay this with a check or money order made out to Treasurer - State of New Jersey.

Certified copies of Burlington County birth, death, marriage, domestic partnership, and civil union records are available from the Office of Vital Statistics and Registry (OVSR) of the New Jersey Department of Health. You can order any of these records by using the Vital Records Online Service.

The fee for each certified copy of a birth, death, marriage, domestic partnership, and civil union certificate is $25. The OVSR charges $2 for each additional copy of the same record ordered at the same time as well as a $5 processing fee and a$5 fee for identity verification. These fees are payable with credit cards.

Are Property Records Open to the Public in Burlington County?

The New Jersey Open Public Records Act provides public access to property records in Burlington County. Upon request, Burlington County record custodians must furnish residents with related records.

Where and How to Find Property Records in Burlington County

The Burlington County Clerk is responsible for maintaining property records in the county. The Clerk's Office has property documents recorded since 1965 and charges $2 per page for plain copies. Certified copies cost a $10 certification fee plus $1 per page. Interested parties may send official requests by mail or email. Parties may also obtain records in person. The Clerk's Office issues a maximum of four documents per request.

A mail request requires a completed request form. The form must be filled with a valid credit card number, the CV number at the back of the card, and the card's expiration date. The requestor must also include the document type and the book and page numbers. Where these numbers are unknown, the form should carry the property instrument number. Municipal Court is a local court created by state law. Its territory is
confined to the City. New Jersey Court Rules govern its practices and procedures. The Municipal Court Judge oversees administration. The presiding Judge of the Municipal Court (County Courthouse, Mount
Holly) oversees administration of all Burlington County Municipal
Courts, and reports to the County’s highest judge, the Assignment
Judge. Municipal Court presides over cases, including:

  • violations of municipal ordinances
  • violations of motor vehicle and traffic laws
  • disorderly person’s offenses
  • petty disorderly person’s offenses and
  • other non-indictable offenses, except where exclusive           jurisdiction is given to the Superior Court. Also included within        this jurisdiction are:
  • violations of fish and game laws
  • weights and measures and
  • marine police.

Staff

Court staff are interested in answering all procedural questions about      how the court will handle your case. Court staff cannot offer legal           advice or make recommendations to you about your case.

Guidelines for Assistance

COURT STAFF CAN...

  • explain and answer questions about how the court works
  • tell you what the court requires in order to consider your case
  • give you some info from your court file
  • provide you with samples of court forms
  • offer guidance on how to fill out forms
  • usually answer questions about court deadlines

COURT STAFF CANNOT...

  • give you legal advice
  • tell you whether or not you should bring your case to court
  • give you a prediction about your case’s outcome
  • recommend a lawyer, but they CAN provide the phone number          of a local lawyer referral service
  • talk to the judge for you
  • let you talk to the judge outside of court
  • change an order issued by a judge

Mediation

The Judge, Court Administrator or a police officer may suggest that the parties try to settle their differences through Mediation, a confidential process which allows the parties to meet with a trained mediator to aid  them in resolving their dispute. You may request mediation:

  • instead of filing a formal complaint
  • or, before your court date

The Court will decide if your case is eligible. Types of matters referred         to mediation typically include:

  • neighborhood disputes
  • bad check cases
  • disputes among co-workers

Your Rights as a Defendant in Municipal Courts in the State         of New Jersey

  1. You have a RIGHT TO BE INFORMED OF THE CHARGES  AGAINST YOU.
  2. You have the RIGHT TO REMAIN SILENT concerning the        charges against you, and anything you say may be held against       you.
  3. You may plead GUILTY or NOT GUILTY to certain non-        indictable charges against you, such as: traffic offenses,         disorderly persons offenses, and ordinances.  If you are              charged    with an INDICTABLE offense, the Judge cannot ask          for your plea because you have the right to request a probable      cause hearing before the Judge and a trial by jury at the County     level if the Grand Jury indicts you.
    There are, however, certain INDICTABLE offenses that may be      tried by the Judge if you waive indictment and trial by jury in     writing and the County Prosecutor consents. You have the right         to be informed if you have been charged with such an offense.
  4. You have the RIGHT TO RETAIN AN ATTORNEY.
  5. You have the RIGHT TO BE ASSIGNED AN ATTORNEY IF:
    • you are charged with an indictable offense and the State    Public Defender determines that you cannot afford an  attorney; or
    • you are charged with an indictable offense and the              Judge determines you cannot afford an attorney and            there is a likelihood that if you are convicted you will           either go to jail, receive a substantial fine or your driver’s license will be suspended.
  6. You have the RIGHT TO OBTAIN A REASONABLE POSTPONEMENT so that you may have an opportunity to        consult with your attorney and prepare a proper defense.
  7. You are PRESUMED TO BE INNOCENT until proven guilty       beyond a reasonable doubt.
  8. You have the RIGHT TO TESTIFY OR NOT TO TESTIFY in             your behalf.
  9. You have the RIGHT TO CALL OR SUBPOENA witnesses to       testify in your behalf.

What to Wear to Court

Please report for jury service wearing respectable clothes.  As a general rule, business or business casual clothing is acceptable.  The following types of clothing are not suitable for court proceedings:  shorts, tube tops, halter tops, clothing that contains any obscene, suggestive or inflammatory print or images, and clothes that are overly dirty or ragged.

No weapons of any kind will be allowed in the Courthouse.  Cellular phones are to be turned off and no use of recording devices or cellular phone cameras is permitted.

Travel, Mileage, and Other Expenses

Jurors are reimbursed for travel to and from residence to the courthouse at a rate of .45 per mile as approved by the supreme court.  

Compensation

Pursuant to state law, you will be paid $30 a day for each day of jury service up to seven days; $50 a day for eight or more days of service.  You may waive the right to compensation, which will help reduce the state's cost of operating the court system.
