The Permit Process

A permit, when required, grants legal permission to start construction.

The information below is the most common process for obtaining a permit; it does not reflect all the conditions you may encounter.

Fairfax County issues several different types of permits for construction projects:

  • Building permits
  • Trade permits (electrical, mechanical and plumbing)
  • Land disturbance permits

Step 2: The Review Process

During the review process, staff from Building Plan Review will review your plan for minimum submission requirements, compliance with construction codes, and other county or state ordinances. You may have a site review along with other agency reviews such as Health Department (if on well or septic), or zoning, depending on your project.

You will be notified of any deficiencies. Plan corrections, resubmission fees and additional supporting documents may be required.

The length of the review process will depend on the type of the project. Plan review timeframes are available online.

When compliance with the building code, zoning ordinance and other applicable statutes are approved, and any outstanding log-out items have been submitted, the permit application is ready for issuance.

Once all final permit fees are paid, you can access your approved plans in ProjectDox and permit in FIDO.

During the entire construction phase, all permits must be placed in a window or other prominent place at the project site and a full-size copy of the county-approved building plans and related documents must be maintained at the site, through construction and inspection phases.

Each phase of construction must be inspected to ensure work is performed in accordance with the applicable code and the approved plans. It is the permit holders' responsibility to contact the county when stages of construction are reached that require a building inspection. Requests for building inspections must be made online.

If an inspector finds that work does not conform to the approved plans, the inspector will fail the inspection and provide comments. Another inspection will be necessary before work is resumed.

Site inspections do not require requests as inspectors conduct their work independently. Site visits are usually unannounced and conducted through an established schedule.

Ladders, scaffolds and other equipment necessary to access construction must be available during in-person building inspections.

Many field changes can be made with your inspector. However, some changes will require another review and approval.

Step 7: Project Completion

When the project is completed and code compliance is determined, the inspector issues a final inspection. The final inspection marks the completion of your project and, if required, the then issued Certificate of Occupancy grants permission to occupy a building with the knowledge that it has met the minimum safety standards as required by code.

When a Permit is Required

Permits are applied for online.  Building plans and other reviews may be required.  For more information on plans, reviews, fees, land disturbance and current building code, visit Development Process Overview.

If a permit is not required

  • Setbacks and other zoning requirements may still apply. Contact Zoning at , TTY , for more information.
  • A land disturbance permit may still apply depending on the size of the disturbance. Email staff, or call , TTY , for more information.  
  • Separate county approval may also be required if the proposed improvement is located within a floodplain or Resource Protection Area (RPA). For more information, call , TTY

Unpermitted Construction

Fairfax County requires a Building Permit for most new residential and commercial construction, which includes, electrical, mechanical, plumbing, and framing installations, and alterations; to include building additions, decks, carport enclosures, finished basements, second kitchens, bathroom and kitchen alterations. If you notice suspicious new construction, demolition of an existing structure, construction equipment or materials, mud on the streets, or work occurring on the weekend or after hours anywhere in the county, contact the Department of Code Compliance to confirm whether a permit is required or was issued to the subject property (address). If the permit requirement is in question, an investigation of the activity would be performed to make that determination. If the investigation reveals the work to be unpermitted, then the  violation notice would be issued requiring permits to be issued and inspections to occur. Your identity will be kept confidential.
